1. Acceptance of Terms

By creating an account and using the TopSpin platform ("the Platform"), you unconditionally agree to these Terms of Service. If you do not agree, do not use the Platform.

2. Eligibility

By creating an account, you represent that:

  • You are at least 16 years old, or have parental/guardian consent if younger.
  • The information you provide is accurate and truthful.
  • You have not been previously banned from the Platform for violating terms.
  • Your use of the Platform complies with applicable law.

3. Account and user responsibility

  • You are solely responsible for maintaining your password security.
  • Multiple accounts (multi-accounting) are prohibited.
  • Account transfer to a third party is prohibited.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Usernames must not be offensive, misleading, or violate third-party rights.

4. Collection and use of personal data

The collection and processing of your personal data (email, phone number, username, real name) is governed by our Privacy Policy. By registering, you provide your explicit consent for:

  • Email: Used for account verification, notifications about challenges, matches, tournaments and Americano events, and support communication.
  • Phone number: Used optionally for player-to-player communication in tournaments and Americano events, and for identity verification in result disputes. Not shared publicly.

5. Fair use

The following actions are strictly prohibited:

  • Use of automated tools (bots, scripts) to interact with the Platform.
  • Exploiting technical errors or weaknesses for personal gain.
  • Harassing other users through challenges, messages, or comments.
  • Creating accounts to manipulate ratings or rankings.
  • Any activity that disproportionately burdens the Platform infrastructure.

6. Match result integrity

Result integrity is fundamental to the rating ladder. Users are required to:

  • Submit truthful and accurate match results.
  • Provide evidence (photos, screenshots) when requested.
  • Not collude for fake matches (match-fixing) or rating manipulation.
  • Accept moderator decisions in dispute cases.
Violation of integrity rules may result in result nullification, rating reset, or account termination.

7. Tournament and Americano integrity

  • Participants must follow the match schedule.
  • Unjustified no-shows may result in penalties.
  • Match fixing or intentional loss for favourable seeding is prohibited.
  • Tournament administrators have final authority on rule enforcement.

8. Intellectual property

  • Platform content: The Platform, logo, code, text, and design are the intellectual property of TopSpin. Reproduction, modification, or distribution without permission is prohibited.
  • User content: You retain ownership of content you submit (photos, evidence), but grant TopSpin a non-exclusive licence to use it for Platform operation.

9. Platform availability

  • TopSpin makes reasonable efforts to ensure continuous Platform operation.
  • We do not guarantee that the Platform will be uninterrupted or error-free.
  • We reserve the right to scheduled or emergency maintenance downtime.
  • We are not liable for damages from temporary unavailability.

10. Limitation of liability

The Platform is provided "as is", without any express or implied warranty. In no event shall TopSpin be liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of data or ratings.
  • Acts or omissions of other users.
  • Match results submitted incorrectly or fraudulently.
  • Damages from unauthorised access to your account.
TopSpin's total liability to any user shall not exceed €50.

11. Subscription Plans

Academies may subscribe to one of three paid plans: Starter, Professional, or Enterprise. Each plan grants access to a specific set of platform features and a monthly credit allowance, as described in the academy sign-up flow.

TopSpin reserves the right to modify the feature sets of each plan at any time, with reasonable notice provided to active subscribers. Feature changes will not materially reduce the functionality of a plan during an active billing period.

12. Billing, Payment and Auto-Renewal

All fees are denominated in Euros (€) and are exclusive of any applicable taxes, including VAT/ΦΠΑ, which will be added at checkout where required by law.

Subscriptions are billed in advance on a monthly or annual basis, as selected at the time of sign-up. Payments are processed securely through Stripe. Full payment card details are handled solely by Stripe and are never stored on TopSpin's servers.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through the academy billing settings. Upon cancellation, you retain access to paid features until the end of the current billing period; no prorated refunds will be issued for the remaining period.

13. Free Trials

Certain plans may be offered with a trial period at a reduced rate (for example, the first month for €1). The full subscription price will apply automatically after the trial period ends unless you cancel before the trial expiry. Only one trial offer is permitted per academy.

14. Refund and Withdrawal Policy

14.1 Right of withdrawal for consumers

If you are a consumer (a natural person acting for purposes outside a trade, business, or profession), you have the right to withdraw from your subscription within 14 days of the contract start date, in accordance with Greek Law 2251/1994 (implementing EU Directive 2011/83). However, if you access and use the paid Platform services during the 14-day withdrawal period, you expressly request that the service begin, and you acknowledge that you lose your right of withdrawal.

14.2 Tournament entry refunds

Refunds for tournament entry fees are governed by the refund policy set by each tournament's organiser, as displayed at the time of entry. TopSpin does not guarantee refunds for tournament entries unless required by law.

14.3 Subscription fee refunds

Subscription fees paid for the current billing period are non-refundable upon cancellation, except as provided by Section 14.1 or as required by applicable consumer protection law.

14.4 Processing time

Where a refund is due, it will be processed through Stripe and may take 5–10 business days to appear in your account, depending on your payment provider.

15. Pricing Changes

We may change subscription prices at any time. If a price increase affects your plan, we will notify you at least 30 days in advance via email or through the Platform. If you do not agree to the new price, you may cancel your subscription before the change takes effect. Continued use of the paid features after the price change takes effect constitutes acceptance of the new price.

16. Credits

Monthly credits are replenished at the start of each billing period and have no monetary value. Credits cannot be exchanged for cash, transferred to another academy, or rolled over to the next billing period unless expressly stated in your plan terms. Enterprise-tier academies have unlimited credits and are not subject to monthly credit allowances.

17. Failed Payments and Suspension

If a subscription payment fails, we will attempt to retry the charge and will notify you by email. After 7 days of non-payment, your subscription enters a grace period during which some features may be restricted. If payment is not successfully processed within 14 days of the original due date, your access to paid features will be suspended and your account will be scheduled for permanent deletion. Data is preserved for 14 days following suspension; you may resubscribe to restore access during this period. After the deletion period, all data associated with your academy will be permanently and irreversibly deleted.

18. Reporting violations

If you discover a violation of these Terms by another user, you may submit a report through the Platform or contact us at topspingr@gmail.com.

19. Account suspension and termination

We reserve the right to suspend or terminate your account, without notice, in the following cases:

  • Violation of these Terms of Service.
  • Submission of false results or evidence.
  • Harassment of other users.
  • Creation of multiple accounts.
  • Use of the Platform for unlawful purposes.
  • Extended period of inactivity (over 12 months).

Upon termination, your data will be deleted in accordance with our Privacy Policy.

20. Governing law and dispute resolution

These Terms are governed by Greek law. Any disputes arising from the use of the Platform shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.
